If you’re dealing directly with a home seller’s agent or a builder’s agent it’s both their goal and their fiduciary duty to achieve the best outcome for their client, The Seller.

 

Likewise, a buyer’s agent has a duty to protect the interests of their client, The Buyer, throughout the transaction. Their responsibilities to you include:

 

1.     Undivided loyalty to avoid conflicts of interest

2.     Confidentiality of your personal information as well as information about the property and the transaction

3.     Full disclosure of their services and anything that might affect the relationship or the transaction

4.     Obedience to your lawful instructions

5.     Reasonable care and skill in their duties as an industry professional

6.     Full accounting of any money or property the client puts in their care

 

Beyond the legal responsibilities an agent has to the buyer, there are other benefits of working with your own agent.

 

Find the right property

 

After determining your budget and what you’re looking for in a home, your agent will guide you towards properties that fit both your wants and needs. They can also explain the pros and cons of various properties and communities, helping you to choose the home that’s right for you.

 

Negotiations

 

Your agent will provide advice on an appropriate price to offer (using comparable sales) and present it to the seller’s agent. They’ll negotiate on your behalf and ensure the accuracy of the contract(s). Their negotiating experience and familiarity with the market can save you money and help your offer stand out to the seller.

 

Commissions

 

In Alberta, the seller is responsible for paying the buyer’s agent’s commission and when you are the seller, all commissions are negotiable.

 

Recommendations

 

Your agent should also be able to refer you to reliable mortgage brokers, real estate attorneys, home inspectors, movers and other professionals. This can help expedite each step of the process and ensure a smooth, stress-free transaction.

 

Overcome setbacks

 

If the home inspection report or appraisal uncovers new issues, your agent can advise you on how to proceed with the transaction and act as a buffer between you and the sellers or their agent. If negotiations become heated or hostile, it’s extremely helpful to have an experienced professional who will remain calm and offer productive solutions.

If you decide to employ the services of a buyer’s agent to purchase new construction, it’s best to work with one familiar with the process. Ask what experience they have with these types of purchases. If it’s a condominium, ask if they have a Condominium Specialist designation so they can help you understand what you’re purchasing, how to deal with condominium documents and what you need to know about existing builder and condo board rules/regulations.
